We wish to establish clearly, for your benefit and ours, the following terms of use necessary to enable the National Workforce Awards to provide our services within the existing legal and regulatory environment of online business and electronic commerce in the United States.

Acceptance of Terms
The following Terms of Use Agreement is a legally binding agreement that shall govern the relationship with our users and others which may interact or interface with National Workforce Awards, LLC, also known as “NWA”, located at P.O. Box 1010, Athens, West Virginia 24712, in association with the use of the NWA website and its Services.

You consent to likewise receive communications from us electronically, such as e-mails, texts, or notices and messages on this site necessary to respond and provide our service to you. You can retain copies of these communications for your records. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

All content on the NWA such as text, graphics, logos, button icons, images, digital downloads, data compilations, and software, along with all physical products from the NWA, are the property of the NWA or its content suppliers and protected by United States and international copyright laws. The compilation of all content included in or made available through the NWA is the exclusive property of the NWA and protected by U.S. and international copyright laws.

Trademarks
In addition, graphics, logos, page headers, button icons, scripts, and service names included in or made available through the NWA are trademarks or trade dress of the NWA in the U.S. the NWA's trademarks and trade dress may not be used in connection with any product or service that is not the NWA's, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits the NWA. All other trademarks not owned by the NWA that appear on the NWA website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by the NWA.

Subject to your compliance with these Terms of Use and your payment of any applicable fees, the NWA grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal, non-commercial, use of the NWA website. This license does not include any resale or commercial use of the NWA, its contents, or products; any collection and use of any product listings, descriptions, or prices; any derivative use of the NWA or its contents; any downloading, copying, or other use of account information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools. All rights not expressly granted to you in these Terms of Use are reserved and retained by the NWA or its licensors, suppliers, publishers, rights holders, or other content providers. No part of the NWA website, or any part of its physical products, may be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any commercial purpose without express written consent of the NWA. You may not use any meta tags or any other "hidden text" utilizing the NWA's name or trademarks without the express written consent of the NWA. You may not misuse the NWA website. You may use the NWA website only as permitted by law. The licenses granted by the NWA terminate if you do not comply with these Terms of Use.

Linking to This Website
Creating or maintaining any link from another web site to any page on the NWA website requires our prior written consent. Running or displaying the NWA website, or any information or material displayed on the NWA website, on any part of a different website, in any form, requires our written permission. Any permitted links to the NWA website must comply with all applicable laws, rules, and regulations.

Your Account
You do not have to create an account to use the NWA website, or to purchase products. If you do create an account, you are responsible for maintaining the confidentiality of your account and password, and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account or password. The NWA reserves the right to refuse service, terminate accounts, terminate your rights to use the NWA, remove or edit content, or cancel orders in its sole discretion.

Reviews, Comments, Communications, and Other Content​
You may post reviews, comments, photos, videos, and other content; send e-cards and other communications; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, profane, threatening, defamatory, invasive of privacy, infringing of intellectual property rights (including publicity rights), or otherwise injurious to third parties or objectionable, and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam" or unsolicited commercial electronic messages. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead the NWA or other users of the site. The NWA reserves the right (but not the obligation) to remove or edit such content.

If you do post content or submit material, and unless we indicate otherwise, you grant the NWA a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant the NWA and sublicensees the right to use the name that you submit in connection with such content. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify the NWA for all claims resulting from content you supply. The NWA has the right but not the obligation to monitor and edit or remove any activity or content. The NWA takes no responsibility and assumes no liability for any content posted by you or any third party.

Intellectual Property Complaints
The NWA respects the intellectual property of others. If you believe that your intellectual property rights are being infringed, please immediately notify us at NationalWorkforceAwards@gmail.com

Shipping, Acceptance, and Limitations​
When an order is placed, it will be shipped to an address designated by the purchaser as long as that shipping address is a U.S. address. You may receive an email from the NWA confirming the order you placed.
We reserve the right, without prior notice, to limit the order quantity on any product or service, to refuse service to any customer, or to cancel any order, for any reason including after it is submitted. We also may require additional verifications or other information prior to the acceptance and/or shipment of any order.

Returns, Refunds, and Title
The NWA does not take title of returned items until the item arrives at our fulfillment center. At our discretion, a refund may be issued without requiring a return. In this situation, the NWA does not take title to the refunded item.

Product Descriptions
The NWA attempts to be as accurate as possible. However, the NWA cannot warrant that product descriptions or other content of the NWA website is at all times free of human error. If you are not satisfied with an NWA product, please contact us so that we can resolve the issue, or return it in unused condition for a complete refund.

Disclaimer of Warranties and Limitation of Liability
Your use of the NWA website is at your risk. The NWA and all information, content, materials, products, software, and other services included on or otherwise made available to you through the NWA are provided by the NWA on an "as is" and "as available" basis, unless otherwise specified in writing. The NWA makes no representations or warranties of any kind, express or implied, as to the operation of the NWA website, or the information, content, materials, products, software, or other services included on or otherwise made available to you through the NWA, unless otherwise specified in writing.
The NWA does not warrant and cannot guarantee that there will never be viruses or harmful materials present in all forms of electronic contact with the website or other communications.

Disputes
Please read this section carefully. It may significantly affect your legal rights, including your right to file a lawsuit in court. Use or accessing the NWA website constitutes your acceptance of this provision.
As a condition of using the NWA website, you and we agree that any and all disputes, claims and causes of action (collectively, “claims”) connected with the NWA website, shall be resolved exclusively by binding arbitration under the rules of the American Arbitration Association, including the supplementary procedures for consumer-related disputes, for full and final settlement of such claim applying the Federal Arbitration Act and other federal arbitration laws. You understand and agree that you are waiving your right to sue or go to court to assert or defend your rights under this contract. You and we also agree that (a) any claims will be resolved individually not as a plaintiff or class representative, member of otherwise on behalf of others in any purposed class, collective, or representative proceeding and not through any class action, (b) if a claim proceeds in court anyway, we both waive any right to a jury trial; and (c) either you or we may seek a court injunction regarding intellectual property infringement.
Arbitration does not involve a judge or jury.
Any dispute or claim relating in any way to your use of the NWA will be adjudicated in the state or Federal courts in Mercer County, West Virginia, and you consent to exclusive jurisdiction and venue in these courts.

Applicable Law
By using the NWA, you agree that applicable federal law, and the laws of the state of West Virginia, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you and the NWA.

Site Policies, Modification, and Severability
Please review our other policies, such as our Privacy Policy, posted on this site. These policies also govern your use of the NWA. We reserve the right to make changes to our site, policies, and Terms of Service at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
